Terms of Service

These are the terms between you and Rally App, Inc., a Delaware corporation doing business as Orbit Studio, for using Orbit at orbitstudio.ai and in the Orbit app. Creating an account or using Orbit means you agree to them. They are short, and they are meant to be read. When they say we, Rally App, Inc. is who they mean.
1. Who can use Orbit
You must be at least 18, or the age of majority where you live, to create an account. Children use Orbit with a parent or guardian, on that adult’s account, and the adult is responsible for what happens on it. If you use Orbit for a child, you agree to these terms on the child’s behalf.
2. Your account
You sign in with a code we email you, so keeping your email account safe is how you keep your Orbit account safe. Tell us at hello@orbitstudio.ai if you think somebody else has used it. We choose your explorer name for you, and you cannot pick or change it. You may not sell, share or transfer your account.
3. Your photos and your hero
You may upload photos only of your own pet, of yourself, of an adult who has agreed to it, or of a child you are the parent or legal guardian of. Do not upload photos of anyone else, of anyone famous, or of anything unlawful.
You keep every right you have in your photos. You give us permission to use them for one purpose: to check them, describe them and draw them into a character sheet, and then to draw that character into the places your hero visits, for your account and nobody else’s. To do that we send them to AI providers that work for us, which do not use them to train their models, and you agree to that before you add any photo. We delete the original photos the moment the hero is created, and we delete an unfinished draft and its photos 30 days after it was last worked on. The Privacy Policy explains this in detail.
A hero’s name is private to you, but it goes into the instructions that draw your hero, so it is filtered and we may refuse or change one. We may remove a hero that breaks these terms.
4. The story world
The stories, places, films, narration, music and artwork in Orbit belong to Rally App, Inc. or to the people who license them to us. You may look at them, walk through them and share links to places for your own personal, non-commercial enjoyment. You may not copy, sell or redistribute them, or use them to train models.
When you open a door nobody has opened before, the place on the other side is created for everyone and stays in the world. You do not own it, and it is not yours to remove. Your explorer name is credited on it. We may close, edit, redraw or remove any place at any time, and we may retire a world.
5. Generated content
Almost everything you see and hear in Orbit is generated by AI models working from stories written by people. It is fiction, it can be strange, and it can be wrong. We check every picture before it is kept, but no check is perfect. If you find something that should not be there, report it from inside the story or write to us, and we will look at it.
6. Rules of the road
Do not try to break Orbit, overload it, scrape it, or get into parts of it that are not yours, including the operator areas. Do not use it to harass or impersonate anyone, and do not upload anything unlawful. Do not try to get around daily allowances or any other limit we set. We may suspend or close an account that breaks these rules, and we may delete what it made.
7. Discoveries, packs and payment
Every day you get a free allowance of first-discoveries, and walking paths that already exist is always free. We may change the size of the allowance.
You can buy discovery packs, and you can subscribe to Orbit Monthly for a larger daily allowance. The price is shown before you pay. A pack contains exactly the number of discoveries it says and never a chance of more, and discoveries from a pack do not expire. Discoveries have no cash value and cannot be sold or transferred.
Orbit Monthly renews automatically every month at the price shown until you cancel. Bought in the app, it is charged to your Apple Account, and you manage or cancel it in your App Store subscription settings, at least 24 hours before the month ends to stop the next payment. Bought on the website, it is charged through our payment processor, and you can cancel it at any time from the account menu. Either way it stays on until the end of the month you have paid for.
Refunds for purchases made in the app are handled by Apple under its own rules. For a purchase made on the website, write to hello@orbitstudio.ai and we will help. If a purchase is refunded or reversed, the discoveries it added come off your account.
8. Deleting things
You can delete a hero from its page at any time, and that deletes everything made from it. You can delete your whole account from Settings in the app or from the account menu on the website, and it happens straight away. Deleting your account cancels a subscription bought on the website; one bought in the app is cancelled in your App Store subscription settings. Places you were the first to open stay in the world for everyone, because they hold nothing of yours.
9. Changes to Orbit and to these terms
Orbit is young and it changes. We may add, change or remove features, redraw places, and retire worlds. We may also change these terms. When we do, the date at the top changes, and if a change matters we will tell you here or by email. Using Orbit after a change means you accept it.
10. No warranty
Orbit is provided as it is and as it is available. To the fullest extent the law allows, we make no promises that it will be uninterrupted, free of errors or fit for a particular purpose, and we do not promise that any generated picture, film or story will be accurate or to your taste.
11. Limits on liability
To the fullest extent the law allows, Rally App, Inc. is not liable for indirect, incidental or consequential damages, or for lost data or lost profits, arising from your use of Orbit. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim, or one hundred US dollars if you paid nothing. Some places do not allow these limits, and where they do not, they apply to you only as far as the law permits.
12. Governing law
These terms are governed by the laws of the State of Delaware, without regard to conflict of law rules. If we ever have a dispute, we will try to sort it out by talking first. If that fails, it will be brought in the state or federal courts located in Delaware, and you and we both agree to their jurisdiction.
